1.1 This Promotion (Simba Summer Sale Promotion) is subject to these Simba Summer Sale Terms and Conditions (Simba Summer Sale Terms), promoted by Simba Sleep Limited, UK company 9703422 (Simba), and these Simba Summer Sale Terms are subject to the overarching terms and definitions set out in of Simba's general Terms set out at www.simbasleep.com/pages/terms/ (Simba General Terms). 1.2 To the extent that the definition and the application of an Extra Offer in these Simba Summer Sale Terms conflict with the Simba General Terms in respect of combining promotional discounts, these Simba Summer Sale Terms prevail. 1.3 In these Simba Summer Sale Terms, the following defined terms are used; 1.3.1 All capitalised terms defined in the Simba General Terms appearing in these Simba Summer Sale Terms have the meanings as defined therein. 1.3.2 Promotional Window – means the limited time between 09.00 BST on 21/06/2024 to 23.59 BST on 30/06/2024. 1.3.3 Promotional Price, and Promotional Pricing – means the limited offer price, and the limited time offer pricing, respectively, for Products offered on the Website during the Promotional Window subject to this Simba Summer Sale Promotion. 1.3.4 Typical Price, and Typical Pricing – means the typical price, and the typical pricing respectively, for Products offered on the Website during the Typical Pricing Window. 1.3.5 Typical Pricing Window – means a period prior to the Promotional Window during which Typical Pricing was offered on the Website, commencing on 28/05/2024 and concluding on 20/06/2024. 1.3.6 Joint Promoter – means Blue Light Card, Perkbox, Jointnetwork, Myvouchercodes NHS, Vouchercodes NHS, and Student Beans. 1.3.6 Extra Offer – means various promotional offers which may be available to You, if You are eligible for such offers via joint promotions promoted by Simba and each of the Joint Promoters, and subject to promotional terms made available by the Joint Promoter, subject and pursuant to the relevant promotional offer terms those parties make via their websites which specifically reference an Extra Offer exception which must be included in Website promotional terms and conditions as distinct from being mentioned in the Simba General Terms. 1.3.7 Selected Mattresses – all mattresses offered on the Website during the Promotional Window other than refurbished mattresses are Selected Mattresses. 1.3.8 Selected Beds – all beds offered on the Website during the Promotional window other than Orion, Atlas, Lomond, and Platform bed lines, and any refurbished beds from any line, are Selected Beds. 1.3.9 Specified Combination – has the meaning given to it in clause 3.1.4.1 and applies whether that combination of Products or part of that combination of Products would otherwise be defined as a bundle or not. 1.3.10 Selected Pillows - Hybrid Pillows, Hybrid Firm Pillows, and Body Pillows other than refurbished Hybrid Pillows, Hybrid Firm Pillows, and Body Pillows, where sold individually, are Selected Pillows 1.3.11 Bundle Selection Pillow - Hybrid Pillows and Hybrid Firm Pillows other than refurbished Hybrid Pillows and Hybrid Firm Pillows, sold as part of a bundle, are each a Bundle Selection Pillow What promotional discounts are available during Promotional Window and how are these displayed on the Website? 2.1 During the Simba Summer Sale Promotion, various reductions to the price of certain Products comparing the Promotional Price of those products with the Typical Price of those Products will apply, as set out in clause 3 below. 2.2 The Promotional Prices will be displayed on the Website during the Promotional Window. 2.3 The Promotional Prices apply when You purchase individual Products, any Specified Combination Products, or bundles of Products offered on the Website subject to certain terms and conditions. How are savings, discounts, and comparisons displayed on the Website during the Simba Summer Sale Promotion calculated? 3.1 Discounts and savings for selected individual new Products on the Website explained: The discounts and savings described for selected individual new Products on the Website during the Promotional Window are based on a like for like comparison with individual new Products of similar specification offered on the Website during the Typical Pricing Window. 3.1.1 All Selected Mattresses are offered at a 25% discount compared with the individual prices at which those Selected Mattresses were offered on the Website during the Typical Pricing Window. 3.1.1.1 † Specific illustrative examples of Selected Mattresses displayed in assets promoting the Simba Summer Sale Promotion may be found at this link at items A and B. 3.1.2 Orion, Atlas, Lomond, and Platform bed lines sold as new are offered at a 30% discount compared with the individual prices at which those bed lines were offered on the Website during the Typical Pricing Window. 3.1.3 Selected Beds are offered at a 25% discount compared with the individual prices at which those Selected Beds were offered on the Website during the Typical Pricing Window. 3.1.4 Where selected in a Specified Combination, during “checkout” from the Website, the Products comprising a Specified Combination are offered at a 25% discount compared with the individual prices at which the Products comprising the Specified Combination were offered on the Website during the Typical Pricing Window. 3.1.4.1 A Specified Combination means specified Products combined in one “checkout” instance on the Website as specified below, where each of the Products is sold as new; 3.1.4.1.1 A mattress and a bed of the same size; and 3.1.4.1.2 A duvet and a mattress of the same size, and two pillows (other than for duvet and mattress combinations in “single” size, in which case one pillow); and 3.1.4.1.3 A duvet, mattress, and bed of the same size, and two pillows (other than for duvet, mattress and bed combinations in “single” size, in which case one pillow). 3.1.5 Selected Pillows are offered at a 20% discount compared with the individual prices at which Hybrid Pillows, Hybrid Firm Pillows, and Body Pillows were offered on the Website during the Typical Pricing Window. 3.1.6 Bundle Selection Pillows are offered at an additional discount beyond the discount described in clause 3.1.5. Illustrative examples of additional discounts on these Products sold in a bundle may be found at this link at item C. 3.2 Comparisons of individual refurbished Products with new Products on the Website explained: Comparisons of refurbished individual Product prices with new Product prices during the Promotional Window give as close to a like for like comparison of individual Products of similar specification as possible, on a refurbished Product price compared with a new Product price, as offered on the Website during the Promotional Window. This takes into account minor Product variances over time which may be reflected in refurbished Products flowing from continuous improvement and range changes. 3.3 Discounts and savings for bundles of selected new Products offered on the Website explained: The discounts and savings described for bundles of new Products on the Website during the Promotional Period are based on a comparison with the prices at which the new Products comprising the bundle are offered on an individual basis, outside a bundle, on the Website, during the Promotional Window. 3.4 Discounts and savings for combining a mattress protector with a selected mattress offered on the Website explained: The discounts and savings described for combining a new mattress protector with a mattress the Website during the Promotional Period are based on an “up to” comparison with the prices at which the new mattress protector, Super King size, is offered on an individual basis on the Website, during the Promotional Window, when included with a mattress. What are the conditions and exclusions applicable to the Simba Summer Sale Promotion? 4.1 Other than an Extra Offer, any other promotion, discount, or offer cannot be combined with the Simba Summer Sale Promotion unless permitted by this clause 4.1’s subclauses. 4.1.1 Where a Product which is a bed named under 3.1.2 is selected as part of a bundle under clause 3.3, or in combination with another Product or Products under clause clause 3.1.4, that bed defined under 3.1.2 will be subject to a 30% discount off the individual price at which that bed defined under 3.1.2 was offered on the Website during the Typical Pricing Window, and the other Products in that bundle will be subject at a 25% discount off the individual price at which the given Product was offered on the Website during the Typical Pricing Window. 4.1.2 These Simba Summer Sale Terms allow an Extra Offer to “top up” an additional discount subject to the specific Promotion Terms and any other exclusions or limitations applicable to an Extra Offer. The maximum discount any Extra Offer may apply will amount to up to a further 2% discount above a Simba Summer Sale Promotion discount saving, and additionally depends on the specific rules set out in the relevant Simba and Joint Promoter’s promotional terms document. 4.1.3 Where an Extra Offer is applied to a Selected Mattress or a Selected Bed, the maximum total discount available subject to the relevant Simba and Joint Promoter’s promotional terms document will be a 27% discount off the individual price at which that Selected Mattress, or 32% discount off the individual price at which that Selected Bed was offered on the Website during the Typical Pricing Window, as applicable. 4.1.4 Where an Extra Offer is applied to a bed defined under 3.1.2, the maximum total discount available subject to the relevant Simba and Joint Promoter’s promotional terms document will be a 32% discount off the individual price at which that bed defined under 3.1.2 was offered on the Website during the Typical Pricing Window. 4.1.5 Where an Extra Offer is applied to a Selected Pillow, the maximum total discount available subject to the relevant Simba and Joint Promoter’s promotional terms document will be a 22% discount off the individual price at which Selected Pillows were offered on the Website during the Typical Pricing Window. 4.1.6 Where an Extra Offer is applied to a Bundle Selection Pillow, the maximum total discount available for Bundle Selection Pillow, subject to the relevant Simba and Joint Promoter’s promotional terms document will be capped at not more than 2% higher than the discount for the Bundle Selection Pillow compared with the individual prices at which the Bundle Selection Pillows is offered on the Website during the Promotional Window.
